A Critique of the Concerns on the Proprio Motu Powers of the ICC Prosecutor

    Kurtulus, Sehmus

During the Rome Diplomatic Conference of Plenipotentiaries where the Rome Statute of the International Criminal Court (ICC) was drafted, the ICC Prosecutor's powers were a matter of dispute. It was particularly the Prosecutor's authority to investigate complaints without any referral from a State Party or the Security Council which led to serious debates among participating States. Though there was wide support for the empowerment of the Prosecutor to activate the trigger mechanism of the ICC proprio motu (on his/her own initiative), there was also strong opposition. Some States described the prosecutorial powers granted to the Prosecutor as 'unacceptable' due to fears such as facing politically motivated prosecutions. Though the previous two prosecutorial terms showed that fears of politicized prosecutions were far-fetched, the process of selecting the third Prosecutor of the ICC for a nine-year term commencing 16 June 2021 once again put a spotlight on the prosecutorial powers as well as on the challenges the new Prosecutor would face. The present study will first draw attention to the judicial scrutiny of the chambers of the ICC and the filtering mechanism of the Rome Statute in an attempt to allay fears that the Prosecutor's powers may lead to politicized prosecutions. The study will then explain, in light of recent developments, why the ICC Prosecutor's power to act proprio motu is crucial for the effective operation of the Court. In so doing, the study will mainly benefit from primary sources such as the Rome Statute of the International Criminal Court, Official Records of the Rome Conference, Reports of the Office of the Prosecutor on Preliminary Examination Activities, Decisions of the Pre-Trial Chambers, as well as the comments made by scholars thereon.

    Uyan, Umut

Although artificial intelligence (AI) is a relatively new technology, it claims to change and transform our business practices. This novel technology, which offers tools that are easy-to-use, fast, and tailor-made outputs in terms of efficiency and productivity, is also becoming more prevalent in higher education. Nonetheless, some ethical issues need to be addressed regarding the use of these technologies for both education and research purposes. This study, designed as a systematic literature review, aims to reveal the ethical concerns regarding such technologies used in scientific publishing activities. Five distinct themes have emerged echoing ethical concerns regarding AI use in scientific publications: Artificially guided research, the illusion of velocity , bias , data quality , and ready-made science. The study serves as a wake-up call to researchers to approach such technologies not only from a cost-benefit perspec-tive, but also to examine potential ethical considerations. Among the pioneering studies on AI usage for scientific publication in higher education, this study will add to the body of knowledge.

SEASONAL CHANGES IN ANTIOXIDANT DEFENCE SYSTEM ON BROWN TROUT (SALMO SP.) IN MUNZUR STREAM

Can, Erkan; Cikcikoglu-Yildirim, Nuran; Erdogan, Devrim

The aim of the present study was to evaluate the oxidant and antioxidant status of the indigenous brown trout (Salmo sp.) caught from Munzur stream (Tunceli, Turkey) at different seasons in different tissues. Glutathione peroxidase (GPx), catalase (CAT), superoxide dismutase (SOD), total antioxidant status (TAS) and total oxidant status (TOS) levels were measured. These measurements were read in a microplate reader using commercial kits with ELISA method. At the end of the study, significant variations of oxidative stress biomarkers were observed between seasons and tissues. The results of this study show that oxidative stress responses in tissues of Salmo sp. are sensitive to the tissues and the seasons in relation to the contaminants, climatic parameters and reproductive period in Munzur stream. The selected parameters are in valuable biomarkers for monitoring of water systems since at molecular levels they give an early warning signal of xenobiotics on aquatic organisms. It was concluded that the measurement of antioxidants biomarkers known such as SOD, CAT and GSH-Px activities, TAS and TOS levels may also be promising indicators of an oxidant impact on aquatic organisms.

On the Archimedean copula constructed from the Bezier polynomial type diagonal section

    Susam, Selim Orhun

In this study, we construct a convex Bezier type diagonal section which uniquely characterizes the Archimedean copula. The proposed diagonal section is flexible according to its polynomial degree; hence, we can add the additional parameters to the diagonal section by increasing the polynomial degree. We also present a graphical tool based on the diagonal section in order to visualize the different types of Archimdean copulas in the copula test space. As an illustration, the real data examples are given.

Volatility Modeling and Spillover: The Turkish and Russian Stock Markets

    Gençyürek, Ahmet Galip

This study investigates the internal and external (spillover) characteristics of the volatility of the Turkish and Russian stock market indices. To this end, generalized autoregressive conditional heteroskedasticity models that are classified as short memory (GARCH, EGARCH, GJR-GARCH, APARCH) and long memory (FIGARCH, FIEGARCH, FIAPARCH, HYGARCH) considering adaptive structure (Fourier series), and the rolling Hong causality methods are used. The analysis spans the years 2003-2020, revealing that the asymmetric power autoregressive conditional heteroskedasticity model is the most appropriate method in terms of both stock indices and leverage and long memory effects are evident in the volatility series. Bidirectional volatility spillovers between Turkish and Russian stock market indices are also evident in all time horizons. Investors can use volatility results for stock valuation, risk management, portfolio diversification, and hedging, and policymakers can consider the volatility results to evaluate the fragility of financial markets.

The study is intended to shed light on walnut species cultivated in Tunceli province in 2022 and the oils produced from Juglans regia Fernor walnuts. Physicochemical properties of walnuts and fatty acid composition of the oils produced from the walnuts were identified. In addition, nutritional indexes and bioactive compounds of the oils were determined.Overall, physicochemical properties of the seeds belonging to walnuts significantly changed according to the variety. The major component in walnut seeds was found to be oil content. Saturated (SFA), monounsaturated (MUFA) and polyunsaturated (PUFA) fatty acid ratios of the walnuts were varied according to the type of seed. Characterization of fatty acid composition in the oils from the walnuts was performed according to 6 different fatty acid levels. These fatty acids are myristic, palmitic, margaric, oleic, linoleic and linolenic acid. The oils have a refractive index being in the range of 1.4677-1.4694, the iodine value being in the range of 107-109 gms. TPC (total phenolic content) and DPPH antioxidant activity of the oils significantly changed according to the variety. TPC of the oils were found in the range of 0.33-1.53 mg GAE/g oil and DPPH antioxidant activity of the oils were in the range of 13.04-5.42 mg TE g(-1) oil. All walnut oils showed Newtonian flow behavior. The nutritional indexes including UI (Unsaturation index), IA (Atherogenicity index), IT (Thrombogenicity index) and HH (Hypocholesterolemic/hypercholesterolemic ratio) were determined to significantly change according to the variety, except for IT. It could be stated from the results that Nazimiye walnut seed oil has healthier effects on human health.

Determination of Metal (Cu, Zn, Se, Cr and Cd) Levels in Tissues of the Cyprinid Fish, Capoeta trutta (Heckel, 1843) from Different Regions of Keban Dam Lake (Euphrates-Turkey)

    Danabas, Durali; Ural, Mesut

The aim of this study was to evaluate Copper (Cu), Zinc (Zn), Selenium (Se), Chromium (Cr) and Cadmium (Cd) concentrations in liver, muscle, gills and kidney tissues of Capoeta trutta collected from four sites of Keban Dam Lake, Turkey. The highest heavy metal level in all tissues was for Zn, while Cd was the lowest. The lowest heavy metal levels were generally found at Station 4 (Agin) for all tissues (p < 0.05). There were statistically significant differences among stations for Cu, Zn, Cr and Se in gills; for Cu, Zn, Se and Cr in liver and kidney; and Cu, Zn and Cr in muscle (p < 0.05). Cadmium concentrations did not differ between sites for any of the tissues. Turkish Food Codex sets the maximum limits of Zn, Cu and Cd as, 50, 20 and 0.05 mg kg(-1) dry weight, respectively, in the muscle of fish used for human consumption. In our study, the level of Zn was higher than Turkish permissible limits only at Station 3 (Guluskur). Cadmium levels were much higher than permissible limits at three stations [S1 (Pertek), S2 (Kockale) and S3], whereas Cu levels were within permissible limits in all stations.

Geo-environmental site investigation for Tunceli, Turkey municipal solid waste disposal site

Önal, Ayten Oztufekci; Demirbilek, Deniz; Demir, Veysel

The environmental and geological condition of a current solid waste disposal site in the city of Tunceli, Turkey was investigated. Improper geological structure and soil properties of this unsanitary solid waste storage site as well as leachate from this site caused significant pollution in air, soil, and surface water. Natural soil characteristics and geology of the site are presented in this paper. Petrographic properties of vulcanized rubber rocks composed of tuff and volcanic sandstone at the bottom of storage sites and the mineralogical composition of the base composed of these rocks were examined. Permeability of the natural soil and index properties were determined using soil mechanics experiments (moisture content, specific gravity, Atterberg limit tests, sieve analysis, hydrometer analysis, falling-head permeability test, and standard proctor test) conducted on disturbed samples collected from excavated sites and the relationship between mineralogical composition and soil hydraulic behavior was investigated. Natural soil samples of six different parts of the site indicated that, the soil class in four samples is silty sands, sand-silt mixtures, one is clayey sands, sand-clay mixtures and one is clayey silts with slight plasticity. The values obtained using permeability tests for subsoil samples vary from 10(-5) to 10(-8) cm/s. Low permeability (10(-7) and 10(-8) cm/s) at the south part of the site increases to 10(-5) cm/s at the natural soil of the North side. Extensively faulted and fissured volcanic sandstone levels at the site give potential to waste leachate to reach deep levels. The soil composition, hydraulic conductivity, topographic conditions, and other location criteria in the current solid waste disposal site showed that the current disposal site is not suitable for this purpose. ARTIFICIAL NEURAL NETWORKS AS NEW ALTERNATIVE METHOD TO ESTIMATING SOME POPULATION PARAMETERS OF TIGRIS LOACH (OXYNOEMACHEILUS TIGRIS (HECKEL, 1843)) IN THE KARASU RIVER, TURKEY

    Ozcan, Ebru Ifakat; Serdar, Osman

In this study, a new method (Artificial Neural Networks) to estimating some population parameters of Tigris loach (Oxynoemacheilus tigris (Heckel, 1843)) collected between 2014 and 2015 in 14 different stations from Karasu River (East Anatolia, Turkey). The total length and weight of the species ranged from 62 to105 mm and from 1.7 to 10.9 g for females and 65 to 100 mm and from 2.4 to 9.8 g for males, respectively. The new maximum length for O. tigris was found to be 105 mm in this study. The length-weight relation of O. tigris was carried out with artificial neural networks (ANNs) and length-weight relationships (LWRs). The results obtained were compared. Length-weight relationships of O. tigris were found as W=0.0049*L-3.29 , R-2 =0.95 for all individuals. According to these values, the growth type of this species was positive allometric (b>3) for all individuals. Regression analysis showed that fish length has high significant correlation with weight (R=0.97, R-2 =0.95, F-1,F-185=31930.3, P<0.001). According to the comparison of the results obtained with MAPE (%), ANNs provide better results than the LWRs. The results of this study could give useful insight that ANNs can be evaluated as an alternative for length-weight relation estimation. The condition factor values (min-max) were observed as 0.680-1.239 for females and 0.699-1.074 for males. No studies have been done before on this species population parameters.

    Geography of OBOR Attempt

    Güner, Bulent

OBOR attempt has manifested the force of Chinese geopolitics and geoeconomics. OBOR is a project where China places in its center and also involves Asia, Europe, Middle East and partly the Africa. Transportation networks, telecommunication, energy networks with the international integration are aimed at this project. OBOR attempt has pretty large territorial limits. It covers 69 member countries, 65% of the world population, 42% of the world's GDP, 75% of the energy reserves known, 40% of the square measure of lands of the world. China has planned the attempt to bring into force in 2049 when will be the 100th year of the foundation of PRC by completing the infrastructure investments within 30-35 years. Much as completing the project has extended over a period, China targets to reach $ 2,5 trillion of annual trade volume among OBOR countries within ten years. OBOR must not be seen as just composed of the infrastructure projects. It is observed that the attempt is going to turn into an international integration by the adaptation in commercial law, establishing free trade areas, and the customs treatises. This paper aims to analyze OBOR attempt that is the subject of the geographical location of the developing processes.
